Please read these terms carefully before using everhere. By using our service, you agree to these terms.

1. Acceptance of Terms

By accessing and using everhere.co.uk ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Age Requirement

You must be at least 16 years old to use the Service. By creating an account, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not use the Service. We reserve the right to request age verification at any time.

4. User Content and Ownership

You retain all ownership rights to the content you upload to the Service, including messages, photos, videos, and documents. By uploading content, you grant everhere a limited license to store, process, and display your content solely for the purpose of providing the Service. We will never sell or share your personal content with third parties.

5. Privacy and Data Protection

We are committed to protecting your privacy and handling your data in accordance with GDPR and UK data protection laws. Your personal information and content are encrypted and stored securely. 6. Subscription Plans and Payments

We offer a single Lifetime Access plan priced at £7.95, providing permanent access to all features. Payments are processed securely through Stripe. We also offer Compassionate Access for eligible users (based on age or medical circumstances) at no cost. Upon purchase, your license is perpetual and non-refundable after the 14-day cooling-off period.

7. 14-Day Cooling-Off Period

UK and EU customers have a 14-day cooling-off period from the date of purchase. If you cancel within this period, a full refund will be issued and your access will terminate. After 14 days, no refunds are available as the license is perpetual.

8. Memorial Access and Legacy Features

Upon verification of death (via death certificate), trusted contacts you have designated will receive access to your content according to your specified permissions. You control sharing on a per-item basis — using the share button on individual memories, messages, documents, and other content to choose exactly who can see each item. We require official death verification to protect against unauthorized access. Memorial pages can be set to public or private according to your preferences.

9. Acceptable Use

You agree not to: (a) upload illegal, harmful, or offensive content; (b) violate the rights of others; (c) attempt to gain unauthorized access to the Service; (d) use the Service for commercial purposes without authorization; (e) impersonate others or provide false information. We reserve the right to remove content and suspend accounts that violate these terms.

10. Content Moderation

We reserve the right to review and moderate content, particularly for public memorial pages and community features. Content that violates our terms or community standards may be removed without notice.

11. Data Backup and Security

While we implement industry-standard security measures and regular backups, you are responsible for maintaining your own backups of important content. We use bank-level encryption to protect your data, but no system is completely secure.

12. Service Availability

We strive to provide continuous service availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect service availability. We are not liable for any loss or damage resulting from service interruptions.

13. Limitation of Liability

To the fullest extent permitted by law, everhere shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

14. Intellectual Property

The Service, including its design, features, and functionality, is owned by everhere and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

15. Third-Party Services

The Service may integrate with third-party services (e.g., payment processors, cloud storage). Your use of these services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party services.

16. Account Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion. Upon termination, you may request a copy of your data within 30 days, after which your data may be permanently deleted.

17. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.

18. Governing Law and Disputes

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Automated Processing and AI Features

The Service uses automated processing and artificial intelligence in the following ways: • AI Assistant: An AI assistant is available within the platform to help you write messages, suggest content, and answer questions. It processes the prompts you provide to generate responses. It does not access your private vault data unless you explicitly share it in the conversation. • Daily Prompts: The platform may automatically generate personalised daily prompts to encourage you to document your legacy. These are generated algorithmically and can be dismissed or disabled in your account settings. • Scheduled Content Release: Messages, sealed letters, and video messages set with a future date or event trigger are released automatically by the system when the specified condition is met. This automation operates according to the rules you configure and does not constitute an automated decision under UK GDPR Article 22, as it carries out your explicit prior instructions. • Inactivity Reminders: The platform monitors account activity and may send automated reminder emails if your account has been inactive for an extended period. These can be disabled in your notification settings. • Death Verification Triggered Release: Following a verified death, the platform automatically adjusts subscription status and prepares access for designated trusted contacts. Final release of content still requires human review of submitted verification documents before access is granted.
